Under Part 107, what must a remote pilot have to conduct Category 2 or Category 3 operations over people?

AA Certificate of Waiver from the FAA.
BPrior ATC authorization for the specific flight area.
CUse of a small UA with an FAA-accepted Declaration of Compliance.

Why →Under 14 CFR §§ 107.120 and 107.130, Category 2 and 3 operations over people require the aircraft to have an FAA-accepted Declaration of Compliance (DoC). A manufacturer-filed document confirming the aircraft meets required injury risk thresholds. A separate Certificate of Waiver is not required.

The trap →BVLOS and other Part 107 deviations use a Certificate of Waiver. Over-people operations in Categories 2 and 3 use a Declaration of Compliance. A completely different mechanism. Confusing the two is a common test trap.

Field note →Several popular drones (DJI Air 2S, Autel EVO series) have received FAA acceptance for Category 2 or 3 operations. Check the FAA's accepted DoC list before any commercial over-people work.
