According to 14 CFR Part 107, who is responsible for determining the performance of a small unmanned aircraft?

Under 14 CFR § 107.49(a)(1), the remote PIC must assess the aircraft's performance prior to each flight to determine if the operation can be conducted safely. While manufacturers provide performance specs, the legal responsibility for determining whether those specs are adequate for a specific operation rests solely with the remote PIC.
The trap →
The manufacturer provides data (max wind speed, battery endurance, temperature limits), but they can't assess your specific mission conditions. The remote PIC takes that manufacturer data and applies it to the current environment. That assessment is their legal responsibility.
